Privacy Policy

This Privacy Policy governs the manner in which WebDiner LLC (“Webdiner”, “we”, “us”) collects, uses, maintains and discloses information collected from users (each, a “User”) of the https://webdiner.com website (the “Site”) and the Webdiner app for iPhone, Android and web (the “App”). This privacy policy applies to the Site, the App and all products and services offered by WebDiner LLC.

Personal identification information

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our Site, register on the Site, place an order, subscribe to the newsletter, fill out a form, use the App, and in connection with other activities, services, features or resources we make available. Users may be asked for, as appropriate, name, email address, phone number and payment information. Users may, however, visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personal identification information, except that it may prevent them from engaging in certain activities.

Non-personal identification information

We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about Users’ means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.

Web browser cookies

Our Site may use “cookies” to enhance User experience. A User’s web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. Users may choose to set their web browser to refuse cookies, or to alert them when cookies are being sent. If they do so, note that some parts of the Site may not function properly.

How we use collected information

WebDiner LLC may collect and use Users’ personal information for the following purposes:

• To improve customer service. Information you provide helps us respond to your customer service requests and support needs more efficiently.
• To personalize user experience. We may use information in the aggregate to understand how our Users as a group use the services and resources provided on our Site.
• To improve our Site. We may use feedback you provide to improve our products and services.
• To process payments. We may use the information Users provide about themselves when placing an order only to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service.
• To run a promotion, contest, survey or other Site feature. To send Users information they agreed to receive about topics we think will be of interest to them.
• To send periodic emails. We may use the email address to send Users information and updates pertaining to their order. It may also be used to respond to their inquiries, questions and other requests. If a User decides to opt in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. If at any time the User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email, or the User may contact us via our Site.

The Webdiner app and AI features

The App lets restaurants whose websites Webdiner builds and hosts request changes to their website. When you use the App (on iPhone, on Android or in a web browser) we collect:

• Account information: your name and email address, to sign you in.
• What you send us: the messages, photos, files and voice requests you send, so we can make the website changes you ask for. Photos and files are stored privately and used only for your website.
• Voice requests: when you choose to dictate a message, your speech is turned into text by the speech recognition built into your device or browser (Apple’s speech recognition on iPhone, which may process audio on Apple’s servers; Google’s speech recognition on Android, which may process audio on Google’s servers; in a web browser, the browser’s own speech service). We receive the text, not the audio, and our AI tidies it up before it is sent.
• Activity records: records of the changes you request and approve, so you can review and undo them, and usage information needed to show your activity and plan limits.
• Device information: a device token, if you allow notifications, so we can send them to your device.

AI processing. Your messages, photos and files are processed by our AI provider, Anthropic, to prepare the changes you ask for. Under our agreement with Anthropic, this content is not used to train AI models. Nothing is changed on your website until you approve it.

The camera, photo library and microphone are used only when you choose to add a photo, scan a menu or dictate a message. The App does not track you across other companies’ apps or websites, does not use your data for advertising, and does not include third-party analytics or advertising software. We do not sell your data.

How we protect your information

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site and in the App.

Sensitive and private data exchanged between the Site or App and its Users is sent over an encrypted (SSL/TLS) connection.

Sharing your personal information

We do not sell, trade, or rent Users’ personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners and trusted affiliates for the purposes outlined above.

We use third-party service providers to help us operate our business, the Site and the App, and they process information only on our behalf and for the purposes described in this policy. These include our AI provider (Anthropic), our payment processor (Stripe), secure cloud hosting and file storage providers (including Cloudflare), and notification services (Apple, Google and Expo) that deliver App notifications to your device. Each is required to protect your information and use it only to provide its service to us.

Data retention

We keep App conversations and the photos and files you send for 12 months by default, after which message text is removed and uploaded files are deleted. We keep billing records and a record of the changes made to your website for as long as needed for accounting, legal and security purposes.

Deleting your account

You can ask us to delete your account at any time by emailing [email protected] from the address you sign in with. You can also reach us through webdiner.com/support. We delete your account and personal data within 30 days of your request, except records we are required to keep for billing, legal or security purposes, such as invoices and the history of changes made to a website. Deleting your App account does not take down your restaurant’s website.

Third party websites

Users may find content on our Site that links to the sites and services of our partners, suppliers, sponsors, licensors and other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our Site. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites which have a link to our Site, is subject to that website’s own terms and policies.

Changes to this privacy policy

WebDiner LLC has the discretion to update this privacy policy at any time. When we do, we will revise the updated date at the bottom of this page. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.

Your acceptance of these terms

By using the Site or the App, you signify your acceptance of this policy. If you do not agree to this policy, please do not use our Site or App. Your continued use following the posting of changes to this policy will be deemed your acceptance of those changes.
